Your Rights & Responsibilities

Every resident has rights and responsibilities. We are committed to upholding your rights, while encouraging mutual respect and understanding among residents, staff, and visitors.

Statement of Rights

From 1 November 2025, the Aged Care Act 2024 introduced a new Statement of Rights. These rights apply to people accessing Australian Government–funded aged care services and are designed to ensure you are treated with dignity, respect, and fairness.
Your Right to Independence and Choice

You have the right to make your own decisions and stay in control of your life. This includes decisions about:

  • Which aged care services you use

  • How you access services and who provides them

  • Your money and personal belongings

  • How you live your life, even if there is some personal risk

If you need help to make decisions, you have the right to receive appropriate support.

Fair and Equitable Access to Care

You have the right to a fair and accurate assessment to determine what funded aged care services you need.

This assessment must:

  • Be done in a way that suits you

  • Respect your culture, background, and personal experiences

  • Take into account trauma you may have experienced

  • Consider cognitive conditions such as dementia

You also have the right to receive the care you need, when you need it.

Safe, High-Quality Care 

You have the right to receive aged care services that are: 

  • Safe, high quality, and fair

  • Delivered with dignity and respect

This includes services that:

  • Value and support your identity, culture, and background

  • Respect your life experiences, including trauma

  • Are accessible and meet your individual needs

  • Are free from violence, abuse, and neglect

You also have the right to care from:

  • Workers with the appropriate skills, training, and experience

  • Providers who meet all legal requirements under aged care laws

Privacy and Access to Information

You have the right to privacy. Your provider must:

  • Respect your personal privacy

  • Protect your personal information, including health and financial details

You also have the right to access information and records about:

  • Your rights

  • The services you receive

  • The cost of your care

Communication, Feedback, and Complaints 

You have the right to:

  • Receive information in a way you understand

  • Communicate in your preferred language or method

  • Use interpreters or communication aids if needed

  • Provide feedback about your care

You can raise concerns or make a complaint:

  • Without fear of punishment or negative treatment

  • With support from your provider

  • With the expectation of a timely and fair response

Advocacy, Support, and Staying Connected

You have the right to support from:

  • An independent advocate

  • A family member, friend, or other person you choose

Providers must respect the role of people who are important to you.

You also have the right to stay connected with:

  • Family, friends, and significant people in your life

  • Your community, including leisure and cultural activities

  • Your pets

For Aboriginal and Torres Strait Islander peoples, this includes the right to remain connected to Country, community, and Island Home.

Consumer Rights Under Consumer Law

In addition to your rights under the Aged Care Act 1997 and other relevant legislation, we also uphold your rights under Australian Consumer Law.
You have the right to:
  • Clear, honest, and complete information about the services provided to you, including information displayed on the My Aged Care website

  • Time to make decisions and ask for help if you need it

  • No pressure or coercion when choosing services

  • Fair and balanced terms in all service agreements

  • A clear and accessible process to resolve disputes or complaints

Your Responsibilities

To help us provide quality care and maintain a respectful environment, we ask that all residents and visitors:
  • Provide accurate information to help us deliver the right care and support
  • Comply with your Service Agreement and pay any agreed fees on time
  • Respect the rights of our staff and others to work and live in a safe, caring, and abuse-free environment
